ORDINANCE: SECOND READING - CITY COUNCIL

 

12. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LA MESA AUTHORIZING AN AMENDMENT TO THE CONTRACT BETWEEN THE CITY COUNCIL OF THE CITY OF LA MESA AND THE BOARD OF ADMINISTRATION OF THE CALIFORNIA PUBLIC EMPLOYEES’ RETIREMENT SYSTEM

Staff recommends the Council approve the second reading and adoption of the Ordinance authorizing an amendment to the contract between the City Council of the City of La Mesa and the Board of Administration of the California Public Employees’ Retirement System (CalPERS), to provide a mandatory employee contribution of .5% of salary as provided under Government Code Section 20516(a) applicable to all Classic CalPERS unrepresented employees and all Classic CalPERS LMCEA members.

16. CONSIDERATION OF AN APPEAL OF THE PLANNING COMMISSION’S APPROVAL OF CONDITIONAL USE PERMIT CUP 17-05 (PARKWAY DRIVE GROUP, INC.) – A REQUEST FOR A MEDICAL MARIJUANA DISPENSARY PROPOSED AT 8160 PARKWAY DRIVE, IN THE C-D (GENERAL COMMERCIAL / URBAN DESIGN OVERLAY) ZONE

Staff recommends the Council uphold the Planning Commission’s approval of Conditional Use Permit CUP 17-05 based on the findings and subject to conditions set forth in Planning Commission Resolution PC-2018-17, thus denying the appeal.

17. RECONSIDERATION OF THE APPEAL FILED BY THE SAN DIEGO CENTER FOR CHILDREN OF THE PLANNING COMMISSION’S APPROVAL OF CONDITIONAL USE PERMIT CUP 17-31 – A REQUEST FOR A MEDICAL MARIJUANA DISPENSARY PROPOSED AT 7339 EL CAJON BOULEVARD, SUITE C, IN THE GENERAL COMMERCIAL, URBAN DESIGN OVERLAY, AND MIXED-USE OVERLAY (C-D-MU) ZONES

Staff recommends the Council consider the information provided in the staff report and the information submitted by the applicant and appellant, receive public testimony, and: (1) reaffirm the City Council’s decision to uphold the appeal based on the findings made in adopting Resolution No. 2018-044, and any additional findings made by the Council, thus denying CUP 17-31; or (2) uphold the Planning Commission’s approval of CUP 17-31 based on the findings and conditions as stated in Planning Commission Resolution PC-2018-11, and any additional findings made by the Council and/or additional conditions adopted by the Council, thus denying the appeal.
